Terms of Service

These terms are the agreement between you and Everrun. The most important clause is the one about service levels — we sell failure detection, so we are explicit about what that promise is and is not. Please read it.

Parties and acceptance

This agreement is between [[PLACEHOLDER: legal entity name]], [[PLACEHOLDER: registered address]] (“Everrun”, “we”) and the business on whose behalf an account is created (“you”). You accept these terms by creating an account or using the service. The Data Processing Addendum is part of these terms.

Business capacity. You confirm that you use Everrun in the course of a business, not as a consumer. To the extent consumer-protection rules could nonetheless apply to you, you expressly request that the service begin immediately during any withdrawal period, acknowledge that the right of withdrawal is lost once the service has been fully performed, and agree that if you withdraw before then you owe a proportionate amount for the service provided up to that point.

The service and plans

Everrun monitors your automation workflows across n8n, Make and Zapier, shows their health in one dashboard, and alerts you when a workflow fails, falls silent, or is switched off on the platform side. Monitoring works through read-only API credentials you supply, or — for Zapier — through heartbeat pings your Zaps send to us. Everrun never writes to your systems.

Three plans, gated on the number of clients you monitor:

Free — $0. 3 clients, 1 seat, 7-day run history.
Growth — $79/month or $790/year. 20 clients, 5 seats, 90-day history.
Scale — $199/month or $1,990/year. Everything in Growth, plus unlimited clients and seats and a 365-day history.

All prices are in US dollars. New accounts start with a 14-day Growth trial — no card required; when it ends without a subscription, the account drops to Free and nothing is deleted — adding beyond the Free limits is simply blocked.

Accounts and seats

Keep your sign-in credentials secure and your account information accurate. You may invite teammates up to your plan’s seat limit; every member of your agency can see and manage everything in it (there are no per-member permissions today). You are responsible for the people you invite.

Acceptable use

Don’t use Everrun to monitor systems you have no right to access, probe or disrupt the service or other tenants, send unlawful content through it, or resell or sublicense access to Everrun itself without our agreement. Using Everrun to monitor automations you build and maintain for your own clients is a normal use of the service, not resale. We may suspend accounts that break these rules.

Your responsibilities

You warrant that you have the right to connect the client systems you connect and to enter the client data you enter — including the right to share your clients’ contact details and workflow names with us for processing under the DPA. Credentials you supply to Everrun must be read-only and scoped as narrowly as your platform allows. You remain responsible for operating your own systems and for your own obligations to your clients.

Ownership and your data

Everrun — the software, design and documentation — remains ours; these terms give you the right to use the service, nothing more. Everything you put into Everrun — client records, connection details, and the monitoring data derived from your platforms — remains yours. You grant us the limited right to process it solely to provide the service, as described in the Privacy Policy and the DPA. If you send us feedback, we may use it without obligation to you.

Billing

Paid plans are billed by Stripe as auto-renewing subscriptions, monthly or annually, in US dollars. Payment details are collected and held by Stripe; we never see card numbers. You can change plan, switch interval, update your card, or cancel at any time in the Stripe customer portal (Settings → Billing). Cancellation takes effect at the end of the paid period — you keep access until then. Cancelling during the trial keeps the remainder of your trial. If a renewal payment fails, access continues while Stripe retries; if payment ultimately fails, the account drops to Free without data loss.

Prices are exclusive of taxes; [[PLACEHOLDER: VAT treatment — e.g. reverse charge for EU business customers, confirm]]. Refunds: fees are non-refundable except where the law requires otherwise; you can cancel at any time and keep access until the end of the paid period. We will give at least 30 days’ notice before a price change affects your renewal.

Service levels — read this

Everrun exists to catch failures, so we owe you a plain statement of what that means: the service is provided on a reasonable-efforts basis, with no uptime guarantee and no SLA. Monitoring works by polling your platforms at intervals and by receiving heartbeats, within the limits of those platforms’ APIs, retention windows and rate limits — so detection can be delayed, and a failure can be missed entirely. Alert delivery depends on email infrastructure we do not control.

Everrun is an early-warning aid, not a replacement for operating your systems. You remain responsible for your own workflows, your own systems, and your own obligations to your clients — including in the event that Everrun fails to detect, or is late to detect, a problem.

Warranty disclaimer

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising out of or related to the service — whether in contract, tort (including negligence) or otherwise — is capped at the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, loss of profits, loss of revenue, or loss of business — including revenue lost through a workflow failure that Everrun did not detect or detected late. Nothing in these terms excludes liability that cannot be excluded by law, including liability for intent or gross negligence.

Suspension, termination and your data

We may suspend or terminate accounts for material breach of these terms, giving notice where reasonable. You may stop using the service at any time: you can delete individual clients and connections yourself in the app (deleting a connection also deletes its monitoring history), and you can request full account deletion by email. We delete your account data from live systems within one month of your request. Otherwise, account data is retained so you can come back. If we terminate your account for breach, we will give you 30 days to request an export before we delete it. Residual copies persist in encrypted backups for up to 90 days, as described in the Privacy Policy.

Changes to the service and these terms

The service will evolve; we may add, change, or remove features. We will not materially reduce the core monitoring capability of your paid plan during a period you have paid for. We may update these terms; for material changes we will notify account email addresses at least 30 days before they take effect. Continuing to use the service after that is acceptance.

General

If any part of these terms turns out to be unenforceable, the rest still stands. These terms, together with the DPA and the Privacy Policy, are the entire agreement between us about the service. You need our consent to transfer your account or this agreement; we may transfer it in connection with a merger, acquisition or sale of the business, with notice to you. Not enforcing a clause once is not a waiver of it.

Governing law and jurisdiction

These terms are governed by Slovenian law, and disputes belong to the courts of the Republic of Slovenia, without prejudice to mandatory provisions in your country.
